Access to and use of MITS Resources (“MITS’s”) Internet website www.medicalintepretingtraingschool.com (the “Site”) is governed by the terms and conditions (“Terms and Conditions”) set forth below, as well as any applicable laws, statutes, ordinances, and regulations. By accessing this Site, you agree to be bound by these Terms and Conditions. If you do not agree to each of these Terms and Conditions, please do not use this Site. Each time you use the Site, the current version of these Terms and Conditions will govern your use. Accordingly, when you use the Site, you should check the date of this Agreement (which appears at the top) and review any changes since the last version. The information and materials on this Site are presented solely for the purpose of promoting the products and services of MITS.

  1. Registration, Accounts, and Passwords

(a) Registration. Some of the features made available on the Site require registration. Upon registration for access to such features, you agree to be responsible for: (i) maintaining the confidentiality of passwords or other account identifiers which you choose and (ii) all activities that occur under such password or account identifiers.

(b) You may not transfer or sell your Account to any other person, and you may not use anyone else’s Account. You may not authorize anyone else to use your or anyone else’s account without our written permission. Violation of this policy may result in termination of your account, in which case you will not be entitled to a refund of tuition and fees.

(c) Security Breaches. You agree to notify MITS of: (i) any loss of your password or other account identifiers and (ii) any unauthorized use of your password or other account identifiers. MITS shall not be responsible or liable, directly or indirectly, in any way for any loss or damage of any kind incurred as a result of, or in connection with, your failure to comply with this section. However, if we (or anyone else) suffer any damage or loss due to the unauthorized use of your account, you may be liable.

(d) 40-hour training program enrollment. You attest that: (i) You are at least 18 years old (ii) You have a high school level of education in the U.S. or another country. (iii) You possess a high level of proficiency in English and another language.

  1. Copyright and Trademark Rights

The materials located on the Site, including, without limitation, the text, graphics, certificates, and all other audible, visual, and downloadable materials, as well as the selection, organization, coordination, compilation, and overall look and feel of the Site (collectively, the “Content”) are the property of MITS or its licensors or designees and are protected by copyright, trademark and other intellectual property laws. All right, title and interest in and to the Content are owned, licensed and controlled by MITS. You may download one computer copy or print one copy of the Content on this Site for your own non-commercial, educational, private or domestic use only, provided you do not delete or change any copyright, trademark, or other proprietary notices. Any other copying, redistribution, retransmission, publication, uploading, translation or modification of any of the Content is strictly prohibited without the expressed written consent of MITS. The use of any of our content or material to train other individuals without written consent or license is strictly prohibited.

The user understands and agrees that Medical Interpreting Training School (MITS) is the sole owner of the Copyrighted content and that any new or derivative works created from the Content (“Derivative Works”) are strictly prohibited without written consent.

Uploading or downloading works protected by copyright without the authority of the copyright owner is an infringement of the copyright owner’s exclusive rights of reproduction and distribution. Anyone found to have infringed a copyrighted work may be liable for statutory damages up to $30,000 for each work infringed and, if willful infringement is proven by the copyright owner, that amount may be increased up to $150,000 for each work infringed. In addition, an infringer of a work may also be liable for the attorney’s fees incurred by the copyright owner to enforce his or her rights.

  1. Indemnification

You agree to indemnify, defend and hold harmless MITS, its respective successors, assigns, affiliates, distributors, licensees, and their past and present officers, directors and employees, representatives, and agents from and against any suit, claim, liability, or proceeding in connection with any third party claim due to or arising out of your violation of these Terms and Conditions.

  1. Severability and Integration

These Terms and Conditions constitute the entire agreement between you and MITS regarding the use of this Site, superseding any prior or contemporaneous communications and proposals between you and MITS. If any provision of these Terms and Conditions shall be deemed unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and Conditions and shall not affect the validity and enforceability of any remaining provisions.

  1. Refund Policy

We believe that our products are of exceptional value and that our clients will be completely satisfied with the content, reliability, and service we provide.  Therefore, we offer a 30-Day Money-Back Guarantee – no questions asked. To be eligible for a full refund, customers must not have accessed any Final Quiz and/or any Certificate of Completion. No refunds after 30 days of purchase. Administrative fees may apply depending on the case. For single Continuing Education Courses, no refunds after 30 days or if more than 40% of the course has been marked complete.

  1. Course Access Time

For students enrolled in the 40-hour program consisting of 10 core modules, there is a time limit of 12 months from the date of purchase to complete the 40 hours of training. Once the course expires, all modules and complementary materials will be removed from the student’s profile. Students who are unable to complete the course within the one-year timeframe have the option to purchase a one-time Extension of three months for a fee of $100. However, if the course has been expired for more than 12 months, Extension eligibility is not available. In such cases, full payment will be required to regain access to the course.

For students enrolled in a 4-hour Continuing Education class, there is a time limit of three months from the date of purchase to complete the training. Once the class expires, the module will be removed from the student’s profile. Students who are unable to complete the class within three months have the option to purchase a one-month Extension for a fee of $15.00.   1. Course Participation 

The student is expected to actively, honestly, and diligently participate in the training program. This includes engaging in the course materials, completing assigned exercises, and actively seeking to acquire the necessary knowledge and skills. Any form of dishonesty, such as plagiarism or cheating, is strictly prohibited.

  1. Course Assessment

The evaluation of acquired knowledge will be carried out through formative assessments. Students must achieve a minimum score of 70% in all quizzes throughout the course. These quizzes can be attempted multiple times to attain the required score.

No final summative exam is required to complete the course. MITS will retain records of scores, logins, and timestamps in its computer system as evidence of attendance. However, if any discrepancies arise or additional verification is needed, students may be asked to submit copies of their coursework to confirm active participation and successful completion.

  1. Content Time Limitations

To enhance understanding and absorption of the training program, MITS has established a maximum limit of eight hours of content per day, or two modules, for all students, regardless of their educational or professional background. Adhering to this limit is crucial to facilitate effective learning and retention of the material.

Participants must fulfill the training program requirements by completing a minimum of 40 hours within the designated timeframe. Deviating from these time limitations may result in disqualification from certificate eligibility or require the submission of evidence demonstrating proper course completion.

  1. Final Certificate of Completion Policy

To obtain a Final Certificate of Completion, students must successfully complete all exercises in the program as indicated by the instructor within the designated timeframe.

Partial completion of the training program, characterized by participants failing to meet the minimum 40-hour requirement or exceeding the stipulated eight-hour daily limit, shall render them ineligible for the issuance of a Certificate of Completion. However, participants may opt to undergo a verification process by submitting the supplementary documentation as required by MITS.

Take notice that MITS does not offer credit or recognition for coursework, degrees, or diplomas acquired from other educational institutions, irrespective of their subject matter’s relevance. Consequently, no other scholastic attainments can serve as a substitute for the issuance of the 40-hour certificate of completion.

  1. Completion Verification Process

In the event that a student exceeds the stipulated eight-hour daily limit or irregularities are found in the timestamps, the following provisions apply:

MITS will contact student and request the submission of supplementary documentation, including completed worksheets, personalized glossaries, and exercise recordings, to validate the completion of the training program.

A verification process will be conducted by MITS to assess the submitted documentation and ensure compliance with program requirements and duration. Additionally, a Zoom session will be scheduled for the student to play the recordings of all interpreting exercises.

Based on the results of the verification process, MITS may implement remedial actions, such as adjusting training hours, completion timeframe, or requiring the student to retake the entire program, to address the violation.

The issuance of the Certificate of Completion is contingent upon successful program completion. Failure to provide satisfactory supplementary documentation or rectify the violation may result in disqualification from certificate eligibility.

MITS retains the authority to determine the review process for supplementary documentation and make decisions regarding certificate eligibility and necessary remedial measures, with its decisions being final and binding.

  1. Academic Dishonesty

In the unfortunate event that a student is found to have engaged in academic dishonesty, such as cheating, plagiarism, fabrication, or misrepresentation within the training program, the following remedial actions shall be taken:

Upon receipt of a credible report or evidence indicating potential violation, MITS will initiate a thorough investigation. This may involve reviewing materials, logins, timestamps, quizzes, and conducting interviews to consider all relevant evidence.

If the investigation confirms cheating or academic dishonesty, MITS reserves the right to impose disciplinary measures, such as warnings, academic penalties, suspension, expulsion, or other necessary actions to uphold program integrity.

In cases of substantiated cheating or academic dishonesty, MITS has the authority to revoke previously awarded certificates or withhold the final certificate associated with the training program. Please note that no refund of the tuition fee will be eligible in such circumstances.

MITS may report the incident to relevant certifying bodies, employers and other stakeholders as required by law or guidelines to maintain educational integrity.

Fair and impartial procedures will be followed, ensuring due process. Students will have the opportunity to present their case, respond to allegations, and provide relevant evidence within the designated timeframe.

Students have the right to appeal decisions regarding cheating or academic dishonesty, following established MITS policies and procedures.

  1. Termination

You acknowledge and agree that MITS, in its sole and absolute discretion, may, without notice to you, suspend or terminate your use of, or access to all or part of this Site, and remove and discard any information or content or any of the Site, for any reason. You further agree that MITS shall not be liable to you or any other person as a result of any such suspension or termination.

  1. Governing Law and Forum

These Terms and Conditions along with MITS’s Privacy Policy shall be governed and construed in accordance with the laws of the State of California, excluding its conflict of law rules. You expressly consent and agree to submit to the exclusive jurisdiction and venue in the state and federal courts located in California. The parties hereby waive any and all rights to a trial by jury. Any cause of action by you with respect to the Site, the Privacy Policy, or any Content or related services must be instituted within six (6) months after the cause of action arose or shall be forever waived and barred.

These terms and conditions form part of the Agreement between the Client (you) and MITS (us). Your accessing of this website indicates your understanding, agreement to and acceptance, of the Disclaimer Notice and the full Terms and Conditions contained herein.

By enrolling in the training program, participants acknowledge and agree to abide by the aforementioned terms and conditions. These conditions are subject to MITS’s sole discretion and may be modified or updated at any time without prior notice.
